DURHAM (AP) — A prosecutor says he's dropped charges against three of the dozen people accused of toppling a Confederate statue in North Carolina in August.

Durham County District Attorney Roger Echols told The Herald-Sun of Durhamthat he dismissed the felony and misdemeanor charges against Aaron Caldwell, Taylor Cook and Myles Spigner.

Echols told the newspaper there was no visual evidence, or other evidence, to show those three took part in ripping down the statue.

Nine others still face charges in the toppling of the statue during a demonstration on Aug. 14.

Law enforcement officers took video but didn't intervene as protesters brought a ladder, one of them climbed the statue to attach a rope and people on the ground yanked down the statue of an anonymous Confederate soldier.
